    REQUIREMENTS TO SECURE YOUR SPACE ON A TRIP
    • A signed copy of this agreement and deposit
    • DIVE ACCIDENT INSURANCE IS REQUIRED ON ALL TRIPS. Level of service purchased is up to each diver. We STRONGLY suggest to you as a traveler that you also purchase Travel Insurance.

    CANCELLATION POLICY
    Once deposited, all cancellation requests or questions are to be emailed to tristatescubatravel@gmail.com and are subject to the penalties outlined below: These outlines follow the requirements Tri-State Scuba has agreed to with the vendor.
    • 120 days or less no refund of money paid.
    • 90 days or less prior to departure you will be responsible for payment in full.

    PAYMENTS
    • Deposit due at the time of booking, along with this Travel Agreement.
    • Payment dates as stated on the invoice or otherwise noted.
    • 100% Final payout is due for all trips 90 days prior to departure unless otherwise noted.

    CHANGES TO ITINERARY
    Any request to alter the packaged itinerary (as sold) on any trip, either prior to a trip or during a trip, is at the participant’s sole expense. Tri-State Scuba reserves the right to allow or disallow any changes to the packaged itinerary of any trip. No refunds will be issued for unused portions of any trip.

    DEPARTURE TAX
    Payment of departure tax (if any) is the sole responsibility of the traveler.

    MARINE PARK FEES
    Payment of Marine Park fees is the sole responsibility of the traveler and generally is payable in cash.

    GENERAL INFORMATION
    • All itinerary schedules may change at any time due to the actions of airlines, hotels, dive centers and tour operators.
    • Not included in package prices (unless otherwise stated); International or in country ground transfers, departure taxes, cost of passports, visas, tourist cards, excess baggage fees, personal expenses such as room service, beverages, laundry, personal communication charges, gratuities, guides, dive operators, drivers, marine park fees, personal insurance or any sight-seeing tours or meals not specifically specified in the itinerary.
    • Tri-State Scuba reserves the right to terminate this contract at any time prior to or during any trip if a traveler is exhibiting disruptive behavior *.
    * Any behavior that is deemed to be potentially harmful, hurtful, unlawful, racist or in any way jeopardizes the quality of the trip. Once a trip is underway, Tri-State reserves the right to ask the disruptive traveler to leave at their own expense.

    SPECIAL SCUBA EQUIPMENT REQUIRED ON ALL TRIPS BY ALL DIVERS (no exceptions)
    • Dive Computer
    • Safety Whistle or Air Horn
    • Surface Marker Buoy (SMB)

    DIVE SHOP CHECK IN PROCEDURES
    All participants must have available a scuba certification card or Nitrox certification card to present to the dive center being visited.

    TERMS AND CONDITIONS
    • Tri-State Scuba, owners - heirs and assigns, associates and employees (THIS VERBAGE IS PART OF EVERY STATEMENT BELOW IN THIS TERMS AND CONDITIONS AGREEMENT) assume no responsibility for injury, loss, damage to person or property or for additional expenses due to acts of God, sickness, weather, terrorism, strike detentions, riots, wars, quarantine, theft, civil unrest, or government regulations and restrictions, over which it has no control.
    • Tri-State Scuba assumes no responsibility for any accidents, delays, inconveniences, expense or mishap of any kind whatsoever resulting entirely or in part from the negligence of others or from causes beyond its control.
    • Tri-State Scuba reserves the right to make changes deemed to be reasonable in itinerary where necessary.
    • Tri-State Scuba assumes no liability should any contracted supplier fail to provide any service.
    • Tri-State Scuba assumes no liability on any excursion planned or unplanned.
    • Handling and security of all baggage and personal belongings is at the owner’s risk and Tri-State Scuba is not responsible for any loss or damage.
    • Tri-State Scuba is not responsible for any loss of life, personal injury, cancellations, delays, overbooking, or loss of services caused by any domestic or international airlines.
    • Tri-State Scuba, its employees and principles are not responsible for any loss of life, personal injury, bodily injury or loss of property as a result of the signer’s participation in any activities while travel to, from or within any country caused by the negligent acts of Tri-State Scuba and/or its employees, representatives or agents.
    • Tri-State Scuba shall be free of responsibility or liability for any act, error, omission, injury to person or property, loss, inconvenience, financial loss, accident, unused accommodations or services, delay, irregularity, physical or emotional harm suffered by any person while enroute to or while a guest at any facility or any other event which may be occasioned by reason or through the employees, any of the services, accommodations or facilities in connection with Tri-State Scuba. This includes non-diving activities.
    • Tri-State Scuba is not responsible for providing refunds or credits for trips not taken or delayed due to a customer’s failure to return this signed document on time.

    RETURN OF THIS SIGNED DOCUMENT IS REQUIRED BY EACH PARTICIPANT PRIOR TO ENGAGING IN ALL TRI-STATE SCUBA ACTIVITIES, DIVE ACTIVITIES, TOURS, AND/OR TRANSFERS. BY SIGNING THIS DOCUMENT BELOW, YOU ACKNOWLEDGE RECEIPT OF THE ABOVE POLICIES, REGULATIONS, AND GUIDELINES AND HEREBY AGREE TO ALL THE TERMS AND CONDITIONS SET FORTH IN THIS DOCUMENT.

    BY THIS DOCUMENT, I DO HEREBY EXEMPT AND RELEASE TRIP LEADER(S) AND HEIRS AND ASSIGNS, INSTRUCTOR(S) AND HEIRS AND ASSIGNS, DIVEMASTER(S) AND HEIRS AND ASSIGNS, THE FACILITY TRI-STATE SCUBA THROUGH WHICH I AM TRAVELING AND ALL RELATED ENTITIES AS DEFINED ABOVE, FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER AS OUTLINED IN THIS CONTRACT; INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH HOWEVER CAUSED, INCLUDING BUT NOT LIMITED TO THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS CONTRACT BY READING IT BEFORE I SIGNED IT ON BEHALF OF MY HEIRS, ASSIGNS AND MYSELF. I FURTHER UNDERSTAND AND AGREE THAT THIS CONTRACT IS IN EFFECT AND VALID FOR ALL ACTIVITIES INVOLVED IN THIS TRIP IN WHICH I PARTICIPATE. CONFIRMATION OF YOUR TRAVEL WILL NOT BE ISSUED TO YOU UNTIL WE HAVE RECEIVED A SIGNED COPY OF THIS DOCUMENT FOR EACH PARTICIPANT AND THE APPROPRIATE DEPOSIT.
