Travel Agreement

    2. AGENCY STATUS & THIRD-PARTY SUPPLIERS
    Tri-State Scuba acts solely as an agent for third-party suppliers, including but not limited to airlines, hotels, dive operators, and transportation providers. These suppliers are independent contractors.
    Tri-State Scuba does not own, operate, or control these suppliers and is not liable for their acts, errors, omissions, or negligence.
    Participant understands that Tri-State Scuba makes no representations or guarantees regarding the performance, safety, or quality of third-party services.
    Participant assumes all risks associated with third-party suppliers, including but not limited to delays, cancellations, equipment failure, and operator negligence.

    3. BOOKING, PAYMENT & CHARGEBACK POLICY
    • $500 non-refundable deposit required to reserve space
    • Full payment due 120 days before departure unless otherwise stated
    • Failure to pay may result in cancellation and forfeiture of funds
    Participant agrees not to initiate any chargeback or payment dispute inconsistent with this Agreement except where required by law.
    In the event of a breach, Participant agrees to reimburse Tri-State Scuba for all costs incurred, including attorney fees, administrative costs, and collection expenses.

    4. CANCELLATION & REFUNDS
    All cancellations must be in writing.
    • 180+ days: Refund minus deposit and supplier costs
    • 179–121 days: 50% refund minus deposit and supplier costs
    • 120 days or less: No refund
    Supplier costs may include non-recoverable deposits, penalties, and prepaid expenses.
    No refunds for missed flights, denied boarding, unused services, or documentation issues.

    5. TRAVEL REQUIREMENTS
    Participant is responsible for all travel documentation, including passports, visas, vaccinations, and compliance with applicable laws.
    Travel documents must be valid for at least six (6) months beyond return date unless otherwise required.

    6. INSURANCE & MEDICAL COSTS
    Dive accident insurance (including hyperbaric treatment and evacuation) is required.
    Travel insurance is strongly recommended.
    Participant acknowledges that emergency evacuation and medical transport costs may exceed $50,000 and agrees to be fully responsible for such costs.
    Participant authorizes emergency medical treatment if necessary and agrees to pay all associated expenses.

    7. DIVING, FITNESS & EQUIPMENT
    Participant certifies that they are properly trained, certified, and medically fit for scuba diving.
    Participant agrees to:
    • Follow all dive professional instructions
    • Disclose all relevant medical conditions
    • Use equipment responsibly
    Participant assumes all risks related to personal and rented equipment.
    Failure to disclose medical conditions may result in denial of participation without refund.

    8. ITINERARY CHANGES & TRIP CONDITIONS
    Tri-State Scuba may modify itineraries due to weather, safety concerns, or supplier issues.
    Participant acknowledges that:
    • Activities are voluntary
    • Remote locations may limit medical access
    • Delays and changes are common in adventure travel
    Trip leaders act as coordinators only and are not safety supervisors unless expressly stated.

    9. PARTICIPANT CONDUCT
    Tri-State Scuba reserves the right to remove any participant without refund for unsafe, illegal, or disruptive behavior.

    10. ASSUMPTION OF RISK
    Participant understands and acknowledges that scuba diving and international travel are inherently dangerous activities that cannot be made completely safe.
    Risks include, but are not limited to:
    • Serious injury or death
    • Decompression sickness
    • Equipment failure
    • Marine life hazards
    • Boat and transportation risks
    • Remote or delayed medical care
    • Communicable diseases (including COVID-19)
    Participant voluntarily assumes all risks, known or unknown.

    11. RELEASE OF LIABILITY
    To the fullest extent permitted by Ohio law, Participant releases, waives, and agrees not to sue Tri-State Scuba & Adventure Travel, LLC, its owners, employees, agents, trip leaders, and affiliates (“Released Parties”) from any and all claims arising from participation in any trip activities.
    THIS INCLUDES CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.

    12. NO DUTY TO SUPERVISE
    Participant understands that Trip Leaders are not responsible for supervising diving activities or ensuring participant safety unless expressly stated in writing.

    13. INDEMNIFICATION
    Participant agrees to indemnify and hold harmless the Released Parties from any claims arising from Participant’s actions, negligence, or failure to follow instructions or laws.

    14. FORCE MAJEURE
    Tri-State Scuba is not liable for events beyond its reasonable control, including but not limited to acts of God, pandemics, travel restrictions, civil unrest, or transportation disruptions.
    Refunds in such cases depend on supplier policies.

    15. LIMITATION OF LIABILITY
    Tri-State Scuba’s total liability shall not exceed the amount paid by Participant.

    16. TRIP MINIMUMS & PRICING
    Trips are subject to minimum participation requirements.
    Prices may change due to fuel surcharges, currency fluctuations, or supplier increases.

    17. MEDIA RELEASE
    Participant consents to the use of photos and videos for promotional purposes unless revoked in writing prior to the trip.

    18. LEGAL TERMS
    • Governed by Ohio law
    • Venue: Hamilton County, Ohio
    • Prevailing party may recover attorney fees
    • Severability applies
    • This is the entire agreement
    Participant acknowledges that they have not relied on any oral representations not contained herein.
    Participant agrees to bring claims only in an individual capacity and waives any right to participate in a class action.
    Disputes may be resolved via binding arbitration in Hamilton County, Ohio.

    19. BINDING EFFECT
    This Agreement is binding upon Participant and their heirs, assigns, personal representatives, and next of kin.

    20. ACKNOWLEDGMENT
    I understand and accept the Assumption of Risk.
    I understand and accept the Release of Liability.
    I accept financial responsibility for medical and evacuation costs.
    I agree to all booking, cancellation, and refund policies.
